Verified Petition Of Kathleen R. Glynn In Support Of Application To Compel Respondent Michael Moore To Arbitrate

Award-winning film and television producer Kathleen Glynn's former husband, Michael Moore (above), has been ordered to appear before the Honorable W. Franc Perry on October 4, 2018 at 9:30a.m. in the New York Supreme Court's 80 Centre Street courthouse.

Moore was ordered in the September 10 court filing to “show cause” why an order Glynn is seeking should not be issued.

In the legal system, an “Order to Show Cause” is a court order requiring an individual or entity to explain, justify, or prove something. In the U.S., courts frequently use orders to show cause to initiate a court proceeding that needs to be heard outside the usual schedule, such as when a temporary order is being sought. In these cases, the court needs additional information before the judge could make such a decision.

Glynn’s September 6, 2018 sought an order to “compel arbitration” and directing that “the parties’ written agreement, as part of the 2104 agreement settling their Michigan divorce action” to engage in binding arbitration and a “written agreement naming retired New York State Supreme Court Justice Saralee Evans as the substitute arbitrator”.

The agreement specified that the arbitration hearing would be conducted by Evans at her Manhattan law office beginning on February 15, 2018.

In Glynn's petition, her attorney Bonnie Rabin nailed Moore, asserting the “proceeding is brought because respondent, Michael F. Moore, realizing that he and his misconduct were exposed and looking for a “do-over”, has simply walked away from the ongoing arbitration process.”
