Battle Creek's “crooked chiropractor”, Robert Buckhannon, will have to cool his heels for another four months until he gets his day in court — federal bankruptcy court, not the criminal variety. A hearing scheduled for September 28 has been delayed until late January 2017.
On August 22, 2016, Buckhannon and Zia Shlaimoun submitted declarations on behalf of the non-existent California-based Goldstar Laboratories LLC regarding a a seven-figure testing lab acquisition from Advanced Biomedical, Inc.
Advanced Biomedical, Inc. (dba Pathology Laboratory Services, Inc.) filed for bankruptcy protection on October 1, 2014 under Chapter 11 of the United States Bankruptcy Code (often referred to as a “reorganization” bankruptcy) in U. S. Bankruptcy Court in the Central District of California.
An attorney representing Advanced Biomedical, Inc. filed evidentiary objections on August 31, 2016 to the Shlaimoun/Buckhannon declarations, extensively detailing doubts on the duo and the credibility of their declarations.
A judge was expected to rule on the Shlaimoun/Buckhannon declarations during a hearing originally scheduled for September 28, but a continuation filed in the case that morning delayed the hearing on the Buckhannon and Shlaimoun declarations until January 25, 2017.
Buckhannon is awaiting trial in U. S. District Court in Nevada for his alleged role in a $34 million dollar hedge fund fraud. Buckhannon was arrested in Henderson, Nevada exactly two years ago, on October 1, 2014. The trial is currently scheduled to begin on April 24, 2017.
In addition, Buckhannon is under investigation for his alleged role in the suspicious December 30, 2013 fire that destroyed Battle Creek's On Deck Sports Bar & Grill. Buckhannon owned the bar with former live-in girlfriend, Kelly Demoss.
