STEVEN INGERSOLL'S MOTION TO VACATE HIS CONVICTION DENIED! United States District Judge Thomas L. Ludington Issues Judgment In Tax Fraud, Conspiracy Case

Judge Thomas L. Ludington advised convicted tax cheat Steven Ingersoll to settle in and enjoy his 41 month taxpayer-funded vacation at FCI Duluth in a judgment filed October 24 in U. S. District Court.

Ludington denied the motion Ingersoll filed on January 24, 2017 seeking to overturn his convictions and set aside his prison sentence.

Dismissing the case “with prejudice”, a final judgment barring Ingersoll from bringing any additional action on the same claim, Ludington also denied Ingersoll's request for a certificate of appealability required for his case to proceed U. S. Court of Appeals Sixth Circuit. 

On January 24, 2017, Ingersoll filed a “pro se” motion to vacate his sentence. 

The motion was referred to Magistrate Judge Patricia T. Morris. The government responded and Ingersoll replied, shifting the blame from Martin Crandall to Jan Geht. 

Morris entered a report recommending denial of Ingersoll’s motion to vacate. 

Although the magistrate judge’s report explicitly stated that the parties to this action could object to and seek review of the recommendation within fourteen days of service of the report, neither party filed any objections. 

The election by Ingersoll not to file objections to the magistrate judge’s report released U. S. District Court from its duty to independently review the record. Ingersoll's failure to file objections to the report and recommendation waived any further right to his appeal. 

In his order, Ludington concluded Ingersoll “failed to make a substantial showing of the denial of a constitutional right, and a certificate of appealability is not warranted in this case.” 

Ludington further concluded that Ingersoll should not be granted leave to proceed in forma pauperis on appeal, as any appeal would be frivolous.
