HONEST SERVICES FRAUD: Resumption Of Steven Ingersoll's Sentencing Hearing Proceedings On December 8 May Not Spell The End Of The Grand Traverse Academy's Legal Woes...It Could Be The Beginning!


Honest services fraud refers to a 28-word sentence of 18 U.S.C. § 1346 (the federal mail and wire fraud statute), added by the United States Congress in 1988, which states: "For the purposes of this chapter, the term scheme or artifice to defraud includes a scheme or artifice to deprive another of the intangible right of honest services."

The statute has been applied by federal prosecutors in cases of public corruption as well as in cases in which private individuals breached a fiduciary duty to another. Honest services fraud is generally more easily proven in the public sphere than in the private, because honest services fraud by public officials can include most unethical conduct, whereas honest services fraud by private individuals only includes some unethical conduct. 


Federal courts have generally recognized two main areas of public-sector honest service fraud: bribery (direct or indirect), where a public official was paid in some way for a particular decision or action, and failure to disclose a conflict of interest, resulting in personal gain.

Coming later today, Miss Fortune examines potential accomplice liability and additional legal woes facing current and former members of the Grand Traverse Academy's Board of Directors.

  1. Wouldn't it be awesome if the boards, supts, managers, all involved with the Administration of the GTA and the Bay City Academy all ended up in prison with Steven? I wonder if they would figure out their roles then. It would be a good start to end all of the unknowing individuals doing the charter school fraud across the state of Michigan. Close all charter schools down. Be a good start to ending the corruption happening with public funds. Hold the charter university accountable for the screw ups of their charters - their oversight includes repaying the fraud for their charters - see how fast that mess is shut down. True responsibility.

  4. The disdain you have for charter schools seeps from your comments. If all and not some public school teachers took pride in teaching, there would not be a need for charter schools. That is just not the case is it? If you open your eyes you would know that. Charter schools are here to stay. Thank God

  6. Personally, I do not believe all of this to be a direct attack on the charter school philosophy, but rather, an attack on the crooked individuals who manage these schools as a "for profit" company.

    What these findings truly show is the corrupt educator (oops I mean "optometrist") who state that they have the SLIGHTEST clue as to how an education business functions. These individuals are not educators, they are businessmen/women looking for ways to profit via public education dollars.......and their greed is their ultimate demise.

    Running a "management company" is an extremely profitable apportunity. However, profit does not mean success......it's an illusion. True success is the students who's lives are changed for the better.

    Should these people go to jail? Yes. When the dust settles, I believe that this corruption will go bleed further then we think. I'll bet there are a lot of people associated with this that are crapping their pants right now because the attention will soon turn to them.

  7. If someone doesn't start cleaning up this charter school debacle there will be no end to the highway robbery. Stand up and take notice Michigan. It is time to come down hard on this and get honesty, integrity and children back into the equation of education and drop the for-profit education business. They are ripping us all off. Make Michigan be the state that stops this!
